CCTV footage from the bar in which an alleged rape victim met the three men charged with raping her revealed one of six inconsistencies in the woman's story a defence lawyer said.
Brothers, Charles Anthony Smith, of Ballarat North, and Matthew Benjamin Smith, of Point Cook, both 21, and co-accused Bennet Crouch, 22, of Wendouree, have been charged with raping the 21-year-old woman in June last year after meeting her at Side by Side bar in Mair Street.
All three have pleaded not guilty to charges in the trial in the County Court at Ballarat.
After meeting at the bar, the four went back to Charles Smith's home, where it is alleged the offences took place.
In his closing address to the jury, barrister Phillip Priest QC, defence counsel for Charles Smith, said in evidence to the court the woman had said she kissed Charles Smith just once on the couch at the bar.
The footage showed a different story with the two sharing many passionate kisses.
``Thank God for the CCTV footage, which demonstrated her version was a completely false and misleading one,'' Mr Priest said.
Mr Priest said the woman made a false complaint of rape to try to save her reputation after she overheard the men making phone calls telling friends about the sexual encounter.
Judge Howard Mason is expected to finish giving his final directions to the jury this morning, after which the jury of four women and eight men will retire to consider their verdict.
