A FEMALE defendant who allegedly had a sexual relationship with a former Ballarat police officer said she was hardly going to say no when he turned up at her house in uniform, a court has heard. The committal hearing of Shaun Perry, 42, continued in Ballarat Magistrates Court yesterday, after a suppression order was lifted late on Tuesday morning.Perry faces charges including two counts of wilful misconduct, and single counts of attempting to pervert the course of justice and unlawful assault. The first witness – a woman who claimed to have had sex with the former police prosecutor on numerous occasions in early 2009 while she was facing her own criminal charges – told the court that Perry had never asked for anything “apart from sex” during their alleged relationship.Later, she added: “You’re hardly going to say no when someone turns up at your door in uniform.”Defence barrister Wayne Toohey alleged there were discrepancies between the woman’s statement to police and her evidence given in court. She admitted that a certain piece of evidence she had given a day earlier was not true — regarding her two children being home on one occasion when Perry allegedly had visited. The court also heard a voice recording which was alleged to have been of the woman and Perry, which lasted about 10 minutes and featured a male and female talking together, and the female laughing at times. The male was heard referring to handcuffs, saying: “Why, do you like them?”After the woman, another five witnesses gave evidence, including her 18-year-old daughter. The daughter claimed she had seen a police officer visit their house in early 2009, and that she had spoken to Perry once on the phone.Mr Toohey suggested to another witness that she was “deliberately committing perjury” and repeatedly called her a liar after she gave different answers when asked how many times she had seen a police officer at the woman’s house.Head of the police prosecution team in Ballarat, Sergeant Robert Anderson was the last witness to give evidence, detailing information regarding Perry’s time as a prosecutor.Sergeant Anderson said Perry had been prosecuting on March 27, 2009, when the woman was said to have fronted court regarding a criminal matter that was eventually diverted. On Tuesday, the woman alleged that hours after Perry first interviewed her at the police station on the day they were said to have met — January 16, 2009 — he went to her house and about 10 minutes after arriving they had sex.The hearing before magistrate Peter Couzens continues this morning.
