Creswick man steals friends' cars, court hears

A MAN stole and damaged two of his friends’ cars after he was kicked out of a Ballarat nightclub and his friends weren’t, a court has heard.

Luke Matthew Evans, 20, had been drinking alcohol all day on October 22 last year before he and two friends went to Rafters nightclub in Lydiard Street.

After the Creswick man was evicted from the club he broke into the victims’ home, took a set of keys and stole one of their cars.

He soon got the vehicle bogged in the median strip of the Western Highway, then made it back to the house and stole the other friend’s car. Evans then drove that vehicle to Melton before ending up near Bacchus Marsh.

Police prosecutor Senior Constable Michelle Burnett said Evans wrote off one of the vehicles which was worth $2000, and had caused $3000 worth of damage to the other.

Defence lawyer David Tamanika said his client was young, alcohol-affected and had an intellectual disability.

But before Mr Tamanika could make sentencing submissions, magistrate Andrew Capell interrupted and decided to adjourn the hearing to enable a pre-sentence report and justice plan to be conducted.

“I think steering him away from licensed premises would be a very good idea,” Mr Capell said. “Really what I’m looking at are restrictions on his behaviour.”

Mr Capell said it seemed there was no malice intended against the two victims, but that alcohol was clearly a significant issue in Evans’ behaviour.

Evans is due back in court on March 22.
