A MELBOURNE drug trafficker who was caught with 48 ecstasy tablets at a Kryal Castle rave last year had his jail sentence increased on appeal yesterday.
But 22-year-old Justin Stark will only serve three months of the nine month jail sentence immediately as the remainder of the time was suspended.
The County Court in Ballarat heard Stark was on appeal bail for other drug related matters when he attended the rave in Warrenheip in December last year.
Police searched Stark after a police sniffer dog detected drugs on him.
Stark was found with a clear plastic bag containing 48 ecstasy tablets and more than $800 in cash.
Cannabis was also found in a Stark's backpack located in a cloakroom.
Crown Prosecutor David Cordy said Stark told police he liked drugs, but denied trafficking.
Stark yesterday appealed a six month jail sentence handed down in the Ballarat Magistrates Court in February.
He had pleaded guilty to trafficking ecstasy, possessing cannabis and ecstasy and dealing with property suspected to be the proceeds of crime.
Defence lawyer Mark Gumbleton told the court Stark had made significant progress on a community based order he was serving for other drug matters and had adhered to strict appeal bail conditions including a curfew.
Mr Gumbleton said Stark had already completed 150 hours of unpaid community work and ran his own handyman business with one employee.
But Mr Cordy said the Ballarat Magistrates Court sentence had been too lenient.
Justice Duckett sentenced Stark to nine months jail, with six months to be suspended.
