AN ENFIELD man who armed himself with a wood splitter before breaking into the home of his ex-wife was yesterday jailed for at least 10 months.
Judge Graeme Crossley described the behaviour of James Morgan Lannen , 32, in the early hours of April 20 as "outrageous" and "absolutely terrifying".
The court had heard Lannen's decision to break into the Talbot St house was driven by the belief that his ex-wife was entertaining a male visitor.
"All the victims of the crime have suffered considerably," Judge Crossley said.
"You must have understood the consequences of your actions."
The County Court in Ballarat heard Lannen had six prior convictions for breaching an intervention order and had experienced difficulties coming to terms with the breakdown of his marriage.
Judge Crossley said he accepted Lannen's behaviour was not planned.
"Your actions were as spontaneous as they were stupid," he said.
The court heard Lannen had since taken part in counselling and had family support.
Judge Crossley said he accepted Lannen had good chances for rehabilitation, but the magnitude of the crime demanded a sentence of some substance.
Lannen was convicted of one count of aggravated burglary and one count of criminal damage.
He was sentenced to two years' jail with a minimum non-parole period of 10 months.
