FORMER television identity Gavan Francis Disney has been found not guilty of three counts of indecent assault.
Judge Paul Lacava directed the jury to return not guilty verdicts yesterday because of insufficient evidence after the prosecution completed its case.
Disney is still facing 10 counts of indecent assault and two of rape. He has pleaded not guilty to those remaining charges.
It is alleged Disney committed the offences against a teenage BTV 6 colleague in the early 1980s.
The direction came shortly before the former Hey Hey It's Saturday producer took to the witness box for one hour to give evidence at the County Court in Ballarat.
The 60-year-old told the jury he strongly denied all the allegations saying he never had a sexual interest in the alleged victim or sexually abused him.
"I got on really well with (the alleged victim). I don't believe I gave (him) any preferential treatment; I respected his talent," Disney said.
He told the jury he had gone out for lunch with the alleged victim in 1993 after he phoned him at Disney's office.
He said normal "chit-chat" took place while they dined. He denied that the alleged victim discussed the sexual abuse allegations with him and that he was considering telling his parents about it.
"I deny these allegations and I don't understand why he is doing it," Disney said.
Disney told the jury the alleged victim did socialise with him outside work on a semi-regular basis.
He said the alleged victim did go to his Ballarat home with other colleagues for social reasons and to give them "some sort of home environment".
A former girlfriend of the alleged victim also gave evidence at yesterday's sitting.
The woman said the alleged victim had never raised the allegations with her during their one-and-a-half-year relationship.
But she said he had once told her that Disney had "groped" him on the "bum".
The trial will continue on Monday where Disney will undergo cross examination.
