Maloney under fire from MLC

Warren Maloney has come under attack from Ballarat Province MLC Dianne Hadden for publishing "misleading and deceptive material" in the lead-up to council elections.

But Cr Maloney has hit back, accusing Ms Hadden of again "demonstrating cowardice".

In Parliament last week Ms Hadden said advertisements headed "Maloney delivers results" and "Maloney delivers results - the next steps" were likely to mislead or deceive voters.

"Cr Maloney's claims are in many instances wrong," Ms Hadden said.

But Cr Maloney said that Ms Hadden thrived on "lies and misinformation".

"She hides behind the legal protections of Parliament to defame and personally attack," he said.

"Hadden will continue, no doubt, to attempt to promote her personal candidates in the council election."

Ms Hadden also claimed Cr Maloney used his council and ratepayer-funded mobile telephone for personal and public use, something Cr Maloney also refutes.

"Council does not pay for any Victorian Local Governance Association or electoral expenses," Cr Maloney said.

The advertisement in question, which was published in The Advocate last week, was referred to the Victorian Electoral Commission by Holcombe ward candidate Bill McClenaghan.

"I had concerns the advertisement was misleading and deceptive and sent it to the VEC for investigation," he said.

However, the Victorian Electoral Commission found the advertisement was not in breach of the Local Government Act.

In a response to Mr McClenaghan electoral commissioner Steve Tully said electoral material would only be misleading under the Act when it was likely to mislead people in relation to how they would physically complete or mark their ballot paper.
