PYRENEES Shire Council wants a written confirmation from the State Government that it is not responsible for the Waubra wind farm.
Residents have complained to council about noise from the wind farm, and if council was responsible it would be its job to ensure the permit conditions were being complied with.
Council chief executive officer Stephen Cornish said that at a meeting with the Department of Planning and Community Development it was said council was responsible for the wind farm.
But Mr Cornish said during the panel process, the department indicated Planning Minister Justin Madden would be responsible, which was the case with other wind farms.
Council wrote to the department on July 31 seeking confirmation.
"We've had no response to that letter and on that basis, we believe the minister is responsible," Mr Cornish said.
"Until we get something in writing, that's the approach we're taking."
Mr Cornish said it would be unfair for the department to revert responsibility to the shire because council had little input into the permit development.
"The unfair nature of it is in the number of panel hearings where the department said the minister was responsible ... which questions the credibility of the panel hearing," he said.
He said Waubra was in a unique situation and it would be a nightmare to administer the whole wind farm.
Pyrenees Shire issued a planning permit for 100 turbines, and the City of Ballarat issued a permit for the remaining 28.
"We have neither the technical skills nor the financial resources to take on the responsibility," Mr Cornish said.
"There is also the liability of us being responsible for the wind farm for the next 25 years."
A spokesman for the department said it had received council's letter and would be replying directly to council.
