A WENDOUREE man had to be sprayed twice with capsicum spray after resisting police and swinging a toy scooter at officers, all while caring for his three-year-old daughter, a court has heard.Craig Donald Bland, 37, was approached by police after he stole just over $50 worth of goods from the Coles supermarket nearby, and then rushed onto a bus waiting in Little Bridge Street.Ballarat Magistrates Court yesterday heard that when police boarded the bus and told Bland to get off it he refused and began fighting with the officers.Police prosecutor Leading Senior Constable Gerard Barrow said Bland became aggressive and was sprayed with capsicum spray, but it had little effect.Bland then started swinging his daughter’s scooter before being sprayed a second time. He was eventually handcuffed and taken to the Ballarat Police Station.The court heard the incident unfolded after Bland and his daughter went shopping at the supermarket where he placed items including Panadol, a toothbrush and an electric thermometer in his pram, and then only paid for items in his basket.Upon being approached by a loss prevention officer outside, Bland said “(expletive) off mate, I’m not coming back,” and got on the nearby bus.Defence lawyer Mike Wardell told the court his client was suffering a serious illness and that medication he was required to take had contributed to the aggressive behaviour.“I think this is genuinely the first report that I’ve had that says a medication can have side effects of anger,” magistrate Michelle Hodgson said of the medical report tendered by the defence.Mr Wardell said Bland had another six weeks of medication to take, and had chosen not to see his daughter until then.Ms Hodgson eventually decided to fine Bland $500.“Your child must have been quite traumatised by the incident,” she said.“You’re coming very close to receiving a sentence if you continue to shop steal.”Bland pleaded guilty to charges including assaulting a police officer on duty, resisting police and theft from a shop.
