A MAGISTRATE yesterday told a Ballarat man who allegedly stole mag wheels that she was giving him a chance by releasing him on bail for the second time this month.
The Ballarat Magistrates Court heard Vernon Bergoyne, 18, and a co-offender climbed over the fence of a Sebastopol caryard in the early hours of Tuesday morning and removed car tyres and rims.
The court heard Bergoyne also climbed in the window of a car and stole a CD player.
Police Senior Constable Trevor Budds said the pair was arrested after putting the stolen rims on a car and taking it to be re-aligned.
Police yesterday opposed bail arguing that Bergoyne was an unacceptable risk of re-offending. Sen Const Budds said Bergoyne had been granted bail on August 14, on charges of burglary and theft from the Ballarat CIU office.
The court heard Bergoyne had an extensive criminal history in South Australia including 12 prior convictions for failing to appear on bail.
Defence lawyer Wilbert Mapombere urged the court to take into account Bergoyne's young age.
Magistrate Kay Robertson said she believed the risk of Bergoyne re-offending could be mitigated.
"If you commit offences, if you are arrested again you will be back before the court probably before me and you won't be getting bail again," she said.
Bergoyne is charged with theft, going equipped to steal and criminal damage.
He was granted bail on condition that he report to the Ballarat Police Station three times a week, adhere to a curfew and not associate with the co-accused.
He will reappear in the Ballarat Magistrates Court on September 11.
