A SUSPENDED lawyer has failed in his attempt to sue the NSW Government and the TAB after he lost almost $5 million in a credit betting scheme.

Christopher Fitzsimons, 62, had claimed he was invalidly approved for a $5000-a-week betting facility by the TAB after providing his daughter's credit card as security. He had sought $4.7 million for losses while taking part in the scheme.
Justice Robert McDougall dismissed his claims and ordered him to pay costs.
During the hearing last month, the barrister for Mr Fitzsimons, Todd Alexis, SC, said Tabcorp had not checked whether the credit card, which had a $20,000 limit, was in someone else's name.
But Justice McDougall found that both the NSW Government and Tabcorp had not acted improperly in their dealings with Mr Fitzsimons.
The court had heard that he was a chronic gambler. Between April 2003 and June 2006 he placed more than 7000 bets under the credit betting scheme.
