With the decision in the hands of the AFL because Brown is techincally still a Gold Coast Suns player, AFL Victoria and Ballan Football Club say the decision is completely out of their control.
It is not yet known when a decision would be made, but Blues president Billy Smith said he hoped to hear either way by the end of the week.
It has been a torrid time for Ballan since announcing Brown would play for the club late last week.
Originally, it was thought he would not be able to play due to a lingering AFL suspension that meant he could not transfer between clubs, which the club only realised after it had planned to host Brown.
It was then revealed the controversial AFL hard man was still technically on the Suns' list, despite being sacked from the club in December last year for punching a teammate.
A timeframe on the ruling has not yet been made.
It is proposed Brown will play for Ballan against Waubra in the Blues first home game for the year on April 12.
