Four interjectors in Victoria's Legislative Council, upset by the remarks of Liberal MP Bernie Finn, have pleaded guilty to disobeying an order to leave the parliamentary precinct.

A Melbourne court heard the two men and two women were referred to by Mr Finn during a debate in March as "thugs, ferals and bludgers" and with having "blood on their hands".

Defence lawyer Jessie Smith told Melbourne Magistrates Court that Mr Finn had referred to her clients "under the cowardly veil" of parliamentary privilege.

Ms Smith said Sean Burke, Samantha Castro, Karen Cochrane and Sean McNamara were "concerned citizens" and sophisticated intellectuals, activists, business owners, charity executives and entrepreneurs.

They were present in the public gallery, she said, to hear debate about the introduction of the so-called "move on" legislation and to "let the executive know that the public watched their actions".

Ms Smith told Deputy Chief Magistrate Lance Martin that the legislation provided "dramatically expanded, draconian and unprecedented police powers".

Police prosecutor Leading Senior Constable Graeme Barron said that after 9pm on March 11, the four began to interject during the debate and were given a lawful direction by the acting president to leave as "numerous interjections from the public gallery" were interrupting and
disturbing the proceedings.

Leading Senior Constable Barron said soon after, they were given several more directions to leave by police and "passively" resisted attempts to remove them before they were taken outside and released lending charges.

He told Mr Martin that Ms Smith's submission that the charges be proven and dismissed was not appropriate and that whether someone was an "intellectual or a dustbin cleaner the law is relevant to all different walks of life".

Ms Smith said Castro, 43, was the only one with a previous court appearance that involved a charge of trespass, for which she was appealing her conviction and sentence to the County Court.

None intended to disrupt Parliament, she submitted, and there was "deep irony in being removed from the public gallery for expressing dissent against laws designed to silence".

In his sentencing remarks, Mr Martin said the defendants were "law abiding citizens with an acute  social conscience" and were "positive contributors to the community".

Mr Martin referred to "certain comments" by Mr Finn that they found "derogatory", but he noted it was fair to say that Parliament was "frequently the scene of robust debate" and the language used was "returned by equally robust language".

He accepted that "many in the community" were opposed to the introduction of the "move on" legislation "principally on the grounds of human rights".

The real "gravamen" of the offence was there had been a failure to leave the chamber, Mr Martin told them, and that they had disrupted Parliament.

He said the right to protest was part of a "heathy democracy" but that right did not allow contravention of laws "put in place for the good order of society".

After deciding that a fine - the maximum fine for the offence was more than $1000 - was not appropriate nor was a dismissal order, each defendant was put on a non-conviction court undertaking.

Castro, of Bundoora, McNamara, 32, of Mt Waverley, Cochrane, 43, of St Kilda, and Burke, 46, of Clifton Hill, agreed to be of good behaviour for 12 months.
