The woman revealed to the trial judge earlier this year that the man had texted her that "Evang G and friends say hi the jury girl ..." and that "they wili [sic] come 2 visit 4 a private party".

A Melbourne court heard that "Evang G" was one of the accused men, Evangelos Goussis, who was then on trial with Warren Shea and Mark Perry, who had all pleaded not guilty.

The woman, who cannot be identified, was discharged from the jury in June before the men were acquitted the following month.

Goussis is serving a life sentence with a 30-year non-parole period for the gangland killings of Lewis Moran and Lewis Caine in 2004.

Chartres-Abbott was on trial in the County Court in 2003, for the rape and mutilation of Mr Perry's ex-girlfriend at a hotel in Prahran in July 2002, when he was shot dead.

Melbourne Magistrates Court was told on Thursday that after the forewoman raised the text message with Justice Lex Lasry towards the end of the trial on June 19, a series of other texts she had recently received from the man, Dan Baron, and other conduct were revealed.

Crown prosecutor Kieran Gilligan said Justice Lasry and others were concerned that Baron, 46, had given Goussis information about the woman, but police investigations "concluded there was no connection".

Mr Gilligan said Baron's relationship with the woman had deteriorated to the point in late 2013 where she wanted him to leave because of his violent and abusive behaviour.

He said that between May and June this year Baron, who knew she had been called for jury duty,  sent her a series of text messages from Telstra pay phones.

Mr Gilligan told magistrate Donna Bakos that the woman was "terrified and extremely distressed" by the "Evang G and friends" text after which she warned Baron he had committed an offence and that police would investigate.

Mr Gilligan read part of Justice Lasry's reaction, which included expressing his anger, that it was a "very significant interference" with a serious case and that whoever ultimately dealt with (Baron) took into account his comments.

Defence lawyer Robert Stary conceded the seriousness of Baron's "debilitating" and continuing conduct, but noted the absence of aggravating features such as physical injury or property damage.

Mr Stary said Baron, who did not know Goussis or his "history", had limited criminal convictions but had strong family support.

Baron, he said, was seriously assaulted in prison after his arrest on June 24, sustaining injuries that included a "smashed" knee cap, a "shattered" left cheek bone and "puncture wounds" to his face from which he spent almost three weeks in hospital.

Mr Stary said his client denied the suggestion the attack was motivated by a drug debt, but he could not say who the assailants were or "who organised the fight in the prison system".

He had not "read the signs" in the collapse of his relationship and had reflected in custody on his conduct that had put him there.

"He is paying a very high price," Mr Stary said, which included being held in protective custody. Ms Bakos will sentence him next month.
