Ms Neville has confirmed the government is getting new legal advice on dismantling the Point Nepean contract signed in the final days of the Napthine government.

"We committed to try and do everything we can to get out of it," Ms Neville said.

"We got legal advice and we are getting additional legal advice on it as we speak," she said.

She said while the government recognised there may be a role for private operators at Point Nepean, it could not support the current deal.

"It is about the particular development, the length of the lease, the development itself is a massive bit of land that sits within the lease, unnecessarily, with some pretty significant vegetation as well," Ms Neville said.

"I am genuinely doing the best we can to get out of this and to re-protect this area," she said.

Ms Neville said she would like the future of the lease "resolved either way within weeks".

Towards the end of last year the Napthine government signed a 50-year lease (with an option to extend) with Point Leisure Group, headed by Richard Shelmerdine.

The lease, to begin in July 2017, covered the historic Quarantine Station site and stretched 64-hectares to include car parks, the Parade Ground, Wombat Oval and Jarman Oval.

A source close to the lease agreement said there was a compensation trigger in the agreement should necessary planning changes needed to facilitate the development not be made by the government.

"There will be a compensation claim... between $1-2 million," they said.

The Point Leisure Group's vision was to turn the site into a health and fitness retreat comprising hot springs, a spa, restaurant, hotel and conference centre.

There would also be a strong focus on coastal and climate research and education.

Before the change of government the developer was moving to test for geothermal water on the site.

Point Leisure Group said they had made a request to meet with the minister to discuss the project and had no further comment at this time.

A government insider said they did not expect any compensation from changes to the lease to cost millions of dollars.

Opposition environment spokesman Brad Battin said "the proposed development at Point Nepean will see a significant saving to the taxpayer of $40 million in maintenance work over the next 20 years, as well as bringing 400 construction and ongoing jobs to the area".

"Daniel Andrews' claim that he will rip up the signed 50-year lease between the State of Victoria and the Point Leisure Group is another example of his reckless approach to Victoria's economic future," he said.

Point Nepean National Park campaigner Kate Baillieu called on the state government to change the lease.

"I would be hoping and expecting that indeed this government would adhere to its election policy to immediately review the leasing arrangements in Point Nepean," she said.

Ms Baillieu said a large area of the park should not be placed in the hands of one developer.

"I think there is widespread community support for it to stay within the national park and for it to be accessible to all," she said.
