Channel Nine will make changes to its landmark mini series House of Hancock after an eleventh hour deal was hammered out between mining magnate Gina Rinehart and the broadcaster permitting the disputed episode to air Sunday night.

Ms Rinehart won the right to "agreed edits" after forcing Nine Entertainment Co. to give her legal team access to the concluding television episode on Friday.

The deal includes undisclosed changes to the original program. A disclaimer would run before and after the Sunday episode's screening and include the word "fictionalised".

It's not expected to be the end of the legal dispute, however. Ms Rinehart's legal representative Tom Blackburn SC would not be drawn if Ms Rinehart would pursue damages for defamation and serious falsehood, a question raised by Justice Peter Garling inside court.

The day before Mr Blackburn had argued promotional trailers for the second episode suggested there was a real prospect the show would broadcast statements that were not entirely accurate.

The two senior producers of the House of Hancock, Nick Murray and Michael Cordell, were present during proceedings but not party to any out-of-court negotiations.

Mr Cordell said after the Supreme Court Hearing he was unaware of the extent of any changes: "The House of Hancock is an important story and we are thrilled it's going to air."

A spokesman for Ms Rinehart confirmed changes had been negotiated: "I can indicate that Channel Nine has agreed to excise certain scenes, and to include appropriate disclaimers."

The disputed second episode is said to feature Ms Rinehart's troubled relationship with her stepmother, Rose Hancock, as well as her half-sister, and ongoing legal action surrounding her children.

The confidential terms of agreement were negotiated outside court during a rare sitting of the Supreme Court on Saturday where it was expected Ms Rinehart would apply for an interlocutory injunction, pulling the show from air.

So hastily put together was the initial agreement, conditions were initially scribbled on loose foolscap paper. As the parties haggled, Justice Garling was forced to adjourn the court twice.

Shortly after 2pm the parties announced to the court they had a deal with both parties agreeing to pay their respective costs. At what cost to dramatic integrity only the producers and possibly a handful of critics will know.
