Fin Mitten, 38, was allegedly caught with almost 16 grams of MDMA, 16 grams of cannabis, 3.5 grams of cocaine, LSD squares and $555 in cash when he was accused of running from police at Rainbow Serpent Festival on January 24.
Ballarat Magistrates Court on Wednesday heard Mitten had been banned from the Lexton festival because of previous alleged incidents and event security were aware of Mitten’s appearance.
Once spotted by security, police informant Sergeant Adam Grant said police were told and began escorting Mitten off the property, about 50 kilometres north-west of Ballarat, before he allegedly ran.
Sergeant Grant said Mitten’s bum bag was searched, with cash and four types of drugs allegedly found in his possession.
Mitten, charged with four trafficking-related offences and deal with the proceeds of crime, appeared in court for a bail application.
Police prosecutor Senior Constable Aimee Heal said police opposed the Elwood man’s application, telling the court he was an unacceptable risk of reoffending and considered a flight risk.
The court heard Mitten had previous drug possession priors in New South Wales, and was described as a “traveller” by his current partner Lei Tran, who was called to give evidence by the man’s defence counsel. Ms Tran said Mitten was a recreational drug user and was not hurting anyone.
Magistrate Frank Jones said based on the allegations, Mitten could have potentially hurt a number of young people.
“He (Mitten) is not just selling it (drugs) at $50 a pop at Coburg Train Station,” he said.
“He is selling drugs to young people and we know at concerts young people die from taking drugs.”
Mr Jones was concerned about bailing Mitten to Ms Tran’s parents’ house.
“They (Ms Tran’s parents) have been asked to bail a drug trafficker to their home, when Ms Tran has already told me her sister has been caught up in drugs,” he said.
Mitten was refused bail and will reappear at Ballarat Magistrates Court March 26.
