A WITNESS in the trial of a Brown Hill man has been accused of identifying the wrong person who assaulted her partner.
Robert Wayne Jeffrey, 51, stands accused of assaulting Robert Linane in March last year, just over 12 hours after a late night incident at Mr Linane's home in which windows were smashed.
Mr Linane's partner Leanne Lawson has been giving evidence in the trial at the County Court in Ballarat, since early yesterday afternoon.
Ms Lawson yesterday told the jury of six men and six women that she had seen a group of people including Jeffrey and his daughter Shannon outside the couple's Ballarat North home hours before Mr Linane was attacked - an assault that left him hospitalised for more than three months.
Ms Lawson said the group - including Jeffrey and Shannon - had made threatening remarks towards the couple and smashed multiple windows.
But defence lawyer Michael Pena-Rees this morning said Ms Lawson had made a wrong identification
"That's not Bob Jeffrey you were looking at," he said, also claiming that Shannon was interstate.Jeffrey has pleaded not guilty to intentionally causing serious injury, aggravated burglary, criminal damage and theft.The trial before Judge Tony Howard continues.
