Judge Frank Gucciardo said on Monday that Daniel Miftode and Ross Jurj had so reduced the fundamental rights of the victim as to "render her an object for your sexual gratification".

Judge Gucciardo told the men they had effectively "debased her in fundamental ways" by their appalling behaviour.

Miftode, 26, formerly of Pakenham, and Jurj, 28, formerly of Berwick, pleaded not guilty to multiple counts of rape, which included a number where each was alleged to have aided and abetted the other.

A jury last March found them both guilty while Jurj was also found guilty of a charge of sexual penetration of a child under 16.

The offences occurred in Hallam in April, 2009, the pair were charged in 2011 and a jury at a first trial in 2012 deliberated for six days but could not reach a verdict.

A second jury in 2013 was discharged for other reasons after a 15 day trial, as was a third jury for technical reasons, before Miftode and Jurj were found guilty this year.

Judge Gucciardo acknowledged the impact of the long legal process on the victim as well as the two men.

He jailed Miftode, who committed more offences, for six years and nine months with a minimum of four years and three months and Jurj, who had been involved for a shorter time, to five years and five months with a minimum of three years and seven months.

In his sentencing remarks, he recounted how the girl was intoxicated outside a railway station when she was offered a lift and later driven to a factory where she was raped.

Judge Gucciardo noted from her victim impact statement the impact of the offending on her that included traumatic psychological scars, the negative effect on her family, relationships and ongoing depression.

He said that Jurj had had a normal childhood and a settled life until the death of his brother in 2007 which led to drug use, but that he had ongoing family support and regarded his prospects of rehabilitation as "probably good".

A psychologist, he said, had assessed Miftode, whose childhood was similarly free from abuse or conflict, with a depressive mood disorder.

Judge Gucciardo said his prospects of rehabilitation "appear to be good".
