Sorrento police pulled the driver over at 1.10am on Saturday when a divisional van pulled the car over for a routine intercept on Pier Street, Rye.
The driver, 47, of Boronia, underwent a preliminary breath test. He was then taken to Rosebud police station where an evidentiary breath test returned a reading of 0.112.
He was driving his girlfriend's car and under new legislation the car must be impounded for 28 days at a cost of $1010.
The man was fined $645. He has lost his licence for 11 months after it was immediately suspended.
