About 9.15pm on Saturday May 14, a 25-year-old man was driving his Toyota Hilux utility in a southerly direction on Orient Street at Willow Vale.
Police believe at the time there were two people in the cab of the vehicle and two others standing in the tray. One of them was a 24-year-old man.
The driver made a right hand turn into Badgery Street and travelled west negotiating a slight left hand bend when the 24-year-old man fell from the tray, landing heavily on the road.
It is believed that he was holding his mobile phone in one hand and a beer bottle in the other.
Emergency services were contacted with Ambulance Paramedics treating the injured man for serious head injuries including a fractured skull and conveyed him to Liverpool Hospital.
The driver failed a roadside breath test and was arrested. He was taken to Bowral Police Station where he underwent a breath analysis which returned a reading of 0.054.
He was then taken to Bowral Hospital for mandatory blood and urine tests and was released pending further inquiries.
