Goodwin Aquilina and his eight-year-old  merino called Jackie Chan set up camp in the gardens about a month ago in protest over their treatment by Moorabool council.

In May the rural council ordered the ram be removed from Mr Aquilina's home in Maddingley, near Bacchus Marsh,   following complaints the animal was dangerous and had attacked people.

On Thursday, staff from Melbourne council, accompanied by police, removed the cardboard house Mr Aquilina had built.

Mr Aquilina says the council is trying to have him evicted. "They say they're going to remove me," he says.

"They keep taking his (ram's) water bucket and blanket, and keep pulling down his structure, they expect us to sleep outside."

He says council staff have torn down his cardboard house every third day.

"They say, 'Why are you getting upset?', and I tell them 'Because you're destroying everything I own'."

"The City of Melbourne is worse than Bacchus Marsch."

Mr Aquilina says he's not sleeping rough, he's protesting.

A Melbourne council spokeswoman says local laws prohibit camping without a permit.

She said the council was working with Mr Aquilina, homeless support service Launch Housing and Moorabool council to see if the pair could return home.

"This work is ongoing," she says.

Leading Senior Constable Adam West says police attended Treasury Gardens on Thursday afternoon to ensure "a breach of the peace did not occur".

In May, Moorabool council told Mr Aquilina he had to find a new home for Jackie Chan or the ram would be seized by the council.

Mr Aquilia vowed to sleep on the street rather than give up his beloved pet.

Council officers say that Jackie Chan has "demonstrated a tendency to attack people".

They have stated that if an attack were to occur on council-managed land, council might be liable.

Mr Aquilina struggles with his mental health due to an acquired brain injury dating from a truck crash 20 years ago.
