Brendan Batchelor on Tuesday pleaded guilty in the Ballarat Magistrates’ Court to five charges, including three charges of disqualified driving.
The court heard Batchelor, who was disqualified from obtaining a licence for 48 months in September after refusing to undergo a breath test, was aware of the status of his licence when he was pulled over by police on December 1, 2015 and January 16 and May 4 last year.
On the third occasion in May, Batchelor was in an unregistered car which had been fixed with false plates.
Legal representation for Batchelor told the court he understood he was at risk of imprisonment, but would like the opportunity to complete a community corrections order.
The lawyer said Batchelor was formally a disengaged youth with a drug problem, but he had since sought help on his own accord.
She said he no longer hung around the wrong peers and was currently looking for employment.
But magistrate Ronald Saines told Batchelor it appeared he was yet to accept that court orders must be complied with.
Since the age of 18 Batchelor has faced the court for unlicensed or disqualified driving on six occasions.
“For someone of 22 years, this is a dreadful driving history,” Mr Saines said.
Batchelor was sentenced to one month imprisonment on each of the three disqualified driving charges, two of which will be served concurrently.
“If you continue to drive while disqualified you can expect longer and longer (jail sentences).”
Unlicensed driver was also over the legal alcohol limit behind the wheel
An unlicensed Ballarat driver who was also over the legal alcohol limit when he decided to get behind the wheel has been jailed for one month.
The Ballarat Magistrates’ Court heard this was not a first time offence for Ballarat’s Corey Baumann, 22, who pleaded guilty on Tuesday to two counts of unlicensed driving, drink driving, careless driving, using an un-roadworthy car, driving an unregistered car and fraudulently using number plates.
During sentencing magistrate Ronald Saines warned Baumann, who had priors for driving disqualified and unlicensed, the more he kept offending like this the more the judicial system would respond.
The court heard Baumann blew 0.076 when he was intercepted near Carisbrook driving on April 1.
He was also charged after he crashed an un-roadworthy car he was driving into a fence near Maryborough on June 5, 2015.
Baumann’s lawyer, David Taminika, told the court his client simply did not place much thought into what he was doing on each occasion.
Urging the magistrate to consider placing Baumann on a community corrections order, Mr Taminika said his client was motivated to complete anything the court imposed.
But magistrate Ronald Saines said he believed jail was warranted for the history of persistently breaching court orders not to drive.
In addition to the one month jail sentence, Baumann was also fined $2000.
