Michael Mitchell faced the Ballarat Magistrates’ Court yesterday for a filing hearing charged with dangerous driving causing death.
He has been bailed to face court again in April for a committal hearing.
On Friday, February 24, 2017, Mr Hubber died at the scene of the crash after colliding with a small truck on the Midland Highway, shortly before 5pm.
The crash was the third serious vehicle collision along the Midland Highway in Newlyn since November 2016, including a fatal crash in late October when a man lost control of his car and hit a tree.
There were five lives lost on the road in the Hepburn Shire in the six months to the crash.
Mr Hubber was farewelled by family and friends in March this year.
