Hayden Wayne Millar, 25, was driving a stolen Holden Commodore while suspended on the wrong side of Bungaree-Wallace Road on February 5.
The young family travelling in their car was forced to swerve off the road moments before another car had to do the same.
Earlier that afternoon Millar had sped off from a random breath test site and was caught overtaking cars on the shoulder of the Bacchus Marsh Road Avenue of Honour at 134km/h in a 60km/h zone while police pursued him.
Police lost sight of Millar, but he was later seen travelling west of the Western Freeway in excess of 150km/h. Police caught up with him near the White Star Hotel where he refused to get out of the car.
A police officer was forced to smash the car’s window and pull Millar out. Millar told police he could not remember anything due to his use of the drug ice.
Millar was on a community corrections order while he committed the offences.
Millar’s defence barrister told the court events in 2014 and 2015 changed the mechanic’s life. She said Millar started dabbling in the drug ice in 2015 after he separated from his partner and his father died.
“This was something that really rattled him. He started drinking heavily,” the defence barrister said.
But Judge Gavan Meredith warned Millar he was at risk of receiving an increased jail sentence. He then abandoned the appeal.
Millar was sentenced to 18 months’ jail with a non-parole period of 10 months at the Ballarat Magistrates’ Court in May. He will be eligible for parole in four months.
