A 17-year-old boy charged over a fatal crash in Ballan missed a children’s court hearing a day before the crash and was on bail.

The teenager, who cannot be identified for legal reasons, faced a children’s court on Thursday over the Western Freeway crash which on Tuesday killed Jacqueline Vodden, 16.
The court was told the boy was due to front court on unrelated charges a day before the crash, including car theft, burglary and aggravated burglary, but he failed to appear.
A warrant was issued for his arrest.
He was then arrested on Tuesday afternoon after he allegedly fled the Ballan crash scene.
The boy’s lawyer said his client had sustained injuries during his arrest on Tuesday and he had seen a doctor.
The court was told the boy refused to provide a forensic sample to police and did not comment during the police interview.
Police made an application to take a forensic sample from the boy, which the magistrate ordered. He told the boy police could use reasonable force to obtain a mouth swab
Four police custody officers flanked the teenager as he sat in the dock during the mention hearing. A further three police officers sat just outside the dock.
The boy remained silent and yawned once during the hearing. A woman, believed to be a family member, sat at the front of the court room.
The boy faces eight charges over the crash, including culpable driving causing death, dangerous driving causing death, failing to render assistance after an accident and car theft.
The court was told he faces multiple other charges in relation to offences allegedly committed from the start of September, including car theft, aggravated burglary and shop theft.
The boy made no application for bail and was remanded to appear at a children’s court on December 18.
