A man allegedly assaulted his former partner at a Sebastopol home before throwing an empty beer bottle at her as she fled in fear with her baby.

The Ballarat Magistrates Court was told during a bail application on Friday Corey Delmenico, 23, was put on a 12-month community corrections order for a family violence incident against the same victim in 2013-2014.
Delmenico was arrested after an alleged incident on October 15 when the victim walked into the kitchen to get a bottle for their five-month-old child.
Constable Anthony Wicking told the court the accused pushed the victim to the ground before he punched and kicked her several times.
He said the accused backed off after the victim managed to get on her feet and picked up a knife.
Police allege she then ran away, but the accused threw an empty beer bottle and as she turned to protect her baby, it hit her in the back.
Delmenico allegedly told the victim he would kill her if she involved her family.
“The victim is opposed to the accused receiving bail. She fears for her safety and believes he will ultimately get in contact with her and the children,” Constable Wicking said.
Police opposed bail, saying Delmenico was at risk of endangering the public’s wellbeing and safety.
Delmenico’s lawyer said her client accepted the alleged offences were serious. She said if granted bail, her client had stable accommodation and strong family support.
She said he was young and it was his first time in custody where he had already served 12 days.
But magistrate Timothy Bourke refused Delmenico’s bail application.
In making his decision, Mr Bourke referred to a Supreme Court family violence case.
He said these cases were receiving greater recognition.
“This is a victim of family violence where there has been a repeat of violence against her,” Mr Bourke said.
He said in light of the alleged serious offending and the accused’s prior community corrections order, he would not grant bail.
Delmenico will return to court on November 13.
