LUMEN CHRISTI PRIMARY SCHOOL: `Violent' pupil, aide sues

A BALLARAT primary school is being sued by a former employee who claims she was injured by a violent pupil.In court documents lodged with the Supreme Court of Victoria, Margaret Isabelle Rees alleges she suffered physical and psychological injuries after an incident with an "aggressive and violent'' pupil at Lumen Christi Primary School in Delacombe.Ms Rees, from Yendon, has claimed she sustained bruising and injuries to her right shoulder, back, and neck while trying to restrain the pupil on June 13, 2003.She also alleges she has since suffered from depression and anxiety.The school has denied Ms Rees' allegations, responding to her statement of claim with a document lodged with the court by a Melbourne law firm.In the document, the school acknowledged two claim forms had been submitted by Ms Rees, relating to stress and injuries to her right shoulder and arm.But it denied allegations of further injuries and said it had not failed in its duty of care to Ms Rees.In her statement, Ms Rees, 51, said that following the alleged incident, she was required to continue with her normal duties at the school, further aggravating her injuries.Her lawyers, Stringer Clark of Warrnambool, claim Ms Rees has been unable to work since just after the incident in 2003, a situation which would continue into the future.The documents show Ms Rees was employed at the Catholic primary school as a part-time integration teacher's aide for almost two years but had been due to move into a full-time position when the incident occurred.Ms Rees claimed the school had failed to provide a safe work place and was negligent because it did not take action against the pupil, who had been violent and aggressive in the past.She alleged Lumen Christi did not have plans in place to deal with violent pupil behaviour and had breached occupational health and safety regulations.The case will be brought before a sitting of the Supreme Court in Warrnambool at a later date.
