A PASSENGER had a blood alcohol level of .157 after he allowed a learner driver, with a higher blood alcohol level than his, drive his car, a court was told yesterday.The woman aged in her 20s, who was not named in Ballarat Magistrates Court, lost control of the car on the Midland Hwy in Clarendon and hit a sign.Darby Leigh Harrison and the woman were uninjured in the crash early on March 13.The court was told Harrison, 38, blew three times the legal limit, while the woman blew .162.Defence lawyer Sue McKenzie said her client, a full licence holder, stated that he was at fault and he should not have let the woman drive.The court was told the pair had previously been at a party.Harrison, of Ballarat, pleaded guilty to one count of drink-driving. He lost his licence for nine months and was fined $500 with conviction.
