CBO for headbutt and threat to kill

A 26-YEAR-OLD man who headbutted a publican and threatened to kill him received a 12-month community based order this week.
Ballarat Magistrates Court heard Robert Fitzpatrick, of Haddon, also assaulted two patrons who tried to defuse the situation at Sebastopol on October 21, 2005.
Police prosecutor Senior Constable Clint Prebble said Fitzpatrick punched one in the face before throwing a punch and a bar stool at the other.
Defence lawyer Jeremy Harper said, although his client had no memory of the night, he did not shy away from his responsibilities.
Mr Harper told the court the irrigator had abstained from alcohol for three to four months and successfully completed the credit bail support program.
As part of the community based order, Fitzpatrick must complete 80 hours of unpaid work and participate in programs to reduced the risk of re-offending.
He pleaded guilty to charges including two counts of unlawful assault.
