The Ballarat Health Services emergency department doctor told the County Court at Ballarat on Wednesday police had told him Yvonne Berry was in a divisional van parked outside the hospital.

They told the doctor she was too aggressive and too violent to be brought into the hospital.

The doctor said he examined a handcuffed Ms Berry as she knelt in the back of the van, describing her as agitated and restless.

“She was co-operative with me examining her,” the doctor said via a video link in the court.

He said he examined Ms Berry for about five minutes and she had no obvious physical injuries.

When the doctor was cross-examined, he said as he was walking back into the hospital Ms Berry attempted to leave the van but police officers prevented her.

Two police officers on duty during the incident on January 14 and 15 in 2015, have been charged with assaulting Ms Berry as she lay in a police cell handcuffed and without her pants.

Leading Senior Constable Nicole Munro, 48, is charged with one count of assault, while Senior Constable Steven Repac, 29, is charged with five counts of assault.

They have pleaded not guilty to their charges.

Another witness told the jury Ms Berry had arrived at her house the morning of the incident with a bottle of red wine. She said Ms Berry had one glass of the wine and left in her car about two hours later.

The prosecution is expected to call its last witness on Thursday.
