The Ballarat Magistrates' Court was told Daniel Conduit, 34, was intercepted driving twice in 2018, following five prior driving while disqualified convictions.
In January 2018, he was stopped by police in a car allegedly not fitted with an Interlock device, and with an expired and disqualified license.
He told police in an interview his partner was unwell - his defence lawyer, Melanie Rodolphus, said she was vomiting while driving, and he had taken over to get them home.
On September 21, 2018, police intercepted Conduit on Magpie Street about 3am.
He was allegedly driving an unregistered car without an Interlock device fitted, while disqualified.
He told police he was on his way to pick up baby formula, as he and his partner were babysitting a newborn.
The father of two had earlier pleaded guilty to the charges while representing himself, however on Tuesday he asked the court for a sentencing indication.
Magistrate Gregory Robinson said the offending was "more of the same".
"I'd indicate prison time" he said.
"I don't see why he should have any special treatment compared to other members of the community."
There was also discussion about a third police brief with further driving charges.
Conduit withdrew his plea of guilty, and will face court again on August 22.
In a separate matter, a 21-year-old man was given a 12 month adjourned undertaking to be of good behaviour for driving unlicensed in Sebastopol in January last year.
The conditions of the bond include complying with a community corrections order, the court was told, after the order was breached last year and reset with another 12 months, including treatment and work hours.
"If he drives again without a license, he's looking at going to jail," Mr Robinson said.
