A man who was taken into custody on Monday for allegedly trespassing into a Delacombe home carrying capsicum spray with an intention to assault a person has now been released.
Craig Scott, 29, appeared via phone from custody at the Ballarat Magistrates' Court on Friday to be told police would withdraw the charges against him.
Police prosecutor Senior Constable Giles Brown said police sought to withdraw the charges because they had received a statement of no complaint from the alleged victim.
Magistrate Letizia Torres explained to Scott he would be released from custody because there were no charges against him anymore.

A man who allegedly trespassed into a Delacombe home carrying capsicum spray with an intention to assault a person has been remanded in custody.
Craig Scott, 29, appeared in the dock at the Ballarat Magistrates' Court on Monday for a filing hearing.
Charge sheets obtained by The Courier reveal Scott allegedly intentionally caused injury to a person at the Delacombe home on January 17.
Police allege he trespassed onto the property with two or more other people and knew the alleged victim was present in the home at the time.
Scott is also charged with stealing a car valued at $1000.
The charges were filed by police informant Detective Senior Constable Luke Aggett on Monday.
Scott said there were no custody management issues for the court to note.
He did not make an application for bail and was remanded in custody.
He will return to court on March 11 for a committal mention.
