The body, which oversees courts across the state, has been charged with two counts of failing to provide a safe workplace between 2015 and 2018.

Alleged failures by Court Services Victoria were highlighted by a coroner last year after an investigation into the September 2018 death of court-employed solicitor Jess Wilby.

The charges do not specifically relate to Ms Wilby's death but encompass a period in which she was employed by the courts.

Findings handed down by NSW coroner Ian Guy revealed Ms Wilby had no mental health issues prior to being appointed acting senior legal counsel for Victoria's Coroners Court in February 2018.

Judge Guy said the most prominent description of the workplace at that time was "toxic".

Ms Wilby had a breakdown at work because of workload pressures but returned the next day. Judge Guy found Ms Wilby's workload remained unchanged and after five weeks she went on sick leave, never returning.

"The pressure she felt at work and her distress about the workplace environment is compelling," he said.

"Her identity was tied to her role and she was proud of what she did. On any view, Ms Wilby was entitled to and deserved better."

Ms Wilby, an aspiring coroner, was 45 when she died.

The case against Court Services Victoria is due in Melbourne Magistrates Court in February next year.
