Ballarat man turns himself into police after stealing wallet, phones

A MAGISTRATE has praised the actions of a man who stole a wallet and two mobile phones, then turned himself in to police when he found images of what he thought was child pornography on one of the phones, a court has heard.

The Ballarat man appeared in Ballarat Magistrates Court yesterday, where a suppression order was issued preventing his name from being published.

Upon learning the man’s actions had led to child pornography charges being laid against a 46-year-old man, magistrate Michelle Hodgson said he needed to be congratulated.

“You did the right thing,” she said. “That kind of offending is very serious. You are to be commended for your conduct even though it placed you at jeopardy of losing your own liberty.”

Police prosecutor Senior Constable Steve Kent said the man had been in the supermarket car park on Little Bridge Street last October when he noticed a car window not fully wound up.

After stealing two mobile phones and a wallet from the vehicle, the man went to the Ballarat Police Station and said he was in possession of a memory card which possibly contained child pornography.

Senior Constable Kent said that despite being warned he may also be prosecuted for theft, the man said he wanted to hand himself in if it assisted police with such investigations. The man also faced charges over a vehicle he stole from outside a Ballarat flat last year.

The court heard that shortly after stealing the vehicle the man was caught speeding outside Ballarat.

Defence lawyer Mike Wardell said his client’s honesty had led to a separate arrest and he deserved credit for this.

Ms Michelle Hodgson sentenced the man to one month in jail and fined him $400. “We don’t want to discourage other like minded people to act in the manner you have,” she said.

The man pleaded guilty to seven charges including theft of a motor vehicle and theft.

Congratulations to the thief for doing the right thing. Whilst he has stuffed up (having been a thief), he has recovered well and I trust that this will continue from this time onwards. Some credit and encouragement where it is due.

Well the guy didn't have to turn himself in. Could have burned the memory card and walked. Cannot condone theft but he shows some decency and guts doing this when he knew what the outcome would be. Says a lot! As does the fact that you won't recognize it say about you What The.

Yes he is a thief there is no question there, however it would have been very easy for him to just simply discard the phone & never give it a second thought & really what's more important two phones and a wallet or INNOCENT children being protected from abuse??!! Credit where credit is due.

I don't care what others think, the young man who stole the phones should be congratulated. I would rather a theif in my community than a child sex offender. People do change and I hope this young man who may have had a hard life as a boy turns his life around for the better!

I agree with ' What the ? ' . This individual admitted to several serious criminal acts, showing no regard whatever for his victims. Just because his crime of theft may not be as vile as another man's crime, it remains a disgusting crime nonetheless. It is also a crime involving total disregard for the feelings of victims. I hope someone rang the Vatican to report a miracle...the judge actually jailed him!

I like the fact that this person, even though they were themselves breaking the law, seen that someone was missusing children and decided to take the punishment to report them. We all make bad decissions in life or take the wrong road, but how many other people would of faced the charges to report the crime? If only there were more crooks like you in the world lol
