Ballarat Magistrates Court: bullet threat for camera operator

AN ANGRY motorist told a speed camera operator he would look better with a "bullet in his head'' after he was caught speeding in Skipton last year.Hamilton's David Mocilac, 39, lost his temper when he saw a speed camera flash on the side of the Glenelg Hwy on July 25 last year and approached the operator who was sitting inside the vehicle. He told him: "I think you would look pretty good with a bullet in your head, what do you think?'' and spat on the window as he walked away.Mocilac was arrested on August 20 and taken to the Hamilton police station where he was interviewed. He told police he wanted to intimidate the operator. The 39-year-old pleaded guilty at the Ballarat Magistrates Court yesterday to one count of threatening to inflict serious injury.Defence lawyer Jon Irwin said his client was sorry and embarrassed for his behaviour, which was out of character. But he said it was not the first time Mocilac had been detected speeding.Mr Irwin said Mocilac was travelling to Melbourne when he was photographed."The speedo indicated that he was less than 5km/h over the speed limit. He lost his temper after he saw the flash on the camera. He went back and was abusive,'' Mr Irwin said.Mocilac has since sought anger management counselling.Magistrate Kay Robertson told Mocilac the community could not have people behaving in that way."You do not take it out on people who are only doing their jobs,'' Ms Robertson said.Mocilac was convicted and released on a 12-month good behaviour bond with the condition he pay $1000 to the court fund and continue his counselling.
