A MAN caught urinating on a morning train packed with commuters at Ballarat Railway Station refused to appear in the dock at the Ballarat Magistrates Court on Monday.

John Wicking, 49, was abusive and threatening towards V/Line staff before trying to light a number of cigarettes in an enclosed area at the station at 8.30 am on August 26, 2013, a court has heard.
Wicking was in police custody for other unrelated matters but would not accompany police to the courtroom.
Wicking's case was adjourned earlier this month for his refusal to see a lawyer and co-operate with police, but magistrate Cynthia Toose was happy to hear the case ex parte with no legal representation for Wicking.
V/Line authorised officer Matthew Williams told the court he boarded a 8.30am train on August 26 and noticed a man, stood on the platform, urinating on the side of the train.
Mr Williams told the court he approached Wicking and asked him to stop was he was doing, before the accused became increasingly abusive.
The court heard Williams felt Wicking, in his current state, was in danger next to a train about the depart and escorted him to the refreshment area of the Ballarat Railway Station where he proceeded to try and light a number of cigarettes in an enclosed area.
Mr Williams told the court he believed Wicking tried to assault him after becoming increasingly agitated in his presence.
"He tried to push past me with a closed fist," he said.
Williams then had to restrain Wicking for 10 minutes before police arrived to arrest the man.
Wicking was charged with six counts of indecent language, trying to smoke in an enclosed space and resist and refuse arrest and magistrate Toose found all the charges proven in Wicking's absence.
Wicking was given an aggregate fine of $800 with conviction.
