Ballarat Magistrates Court on Monday heard Darcy Kroezen and a co-accused had been in the yard about 7.30pm on January 14 when the bird was killed, allegedly by the co-accused, who threw his shoe at it.
While Kroezen played no part in its actual death, the court heard he did torment the bird, waving his jumper around and making it fly.
Police prosecutor Sergeant Ivan Blomley said both men showed “no remorse” after police found the dead bird. “They said they were just having a bit of fun,” he said.
Kroezen pleaded guilty to tormenting an animal.
Andrew Madden, for Kroezen, said he had seen CCTV footage, which showed it was the co-accused who played a “very active role” in the bird’s death.
Magistrate Cynthia Toose sentenced Kroezen, who is serving a sentence for prior matters, to a further two days’ imprisonment.
