A Ballarat bricklayer who was more than three times the legal limit when he fell asleep at the wheel and crashed his car has copped a significant fine.

The Ballarat Magistrates’ Court on Thursday heard Toby Biggs was driving along Doveton Street, towards Mair Street at 11.54pm on September 30 when he fell asleep and hit a traffic light at the intersection. His car was left irreparable.
The court heard Biggs initially blew a positive breath test, and blood tests later that evening detected a blood alcohol reading of 0.157.
His lawyer, David Taminika, told the court while his client is currently on a community corrections order for assaulting two taxi drivers during a drunken rage in 2015, this was his first appearance in court for careless driving and drink driving.
Mr Taminika said Biggs had been out drinking that night with colleagues and “makes bad decisions when he is drinking”.
Biggs, who pleaded guilty to the two charges, was convicted and fined $3000.
