Rape case back before court today

A MAN accused of raping a woman in Brown Hill last Friday night fronted Ballarat Magistrates Court yesterday.Brendan Prestage, 21, of Port Lincoln, faces two charges of rape and one charge of intentionally causing injury.Prestage made a bail application in court yesterday, which will be determined today.Police informant Detective Senior Constable Paul Jolly of Ballarat Criminal Investigation Unit alleged Prestage had been drinking alcohol at a Brown Hill home on Friday night with friends.He said the female victim was also drinking alcohol with the accused, before they left the house at about 11pm."They began getting amorous with each other and things got out of control," Senior Constable Jolly said.It is alleged shortly after, the pair went to a vacant block of land near the house, where they started having sex before the incident became aggressive."At this stage, she's asked him to stop," Senior Constable Jolly said.It is alleged that Prestage punched the victim to the head and knocked her to the ground, before penetrating her."She has laid there for five minutes before she began screaming and the sex assault ceased," Senior Constable Jolly said.The victim later went to the Ballarat Police Station with minor injuries before undergoing a forensic examination at Ballarat Health Services.Prestage made no comment in a later police interview and was remanded in custody.Yesterday Prestage appeared in the docks and was supported in court by a Koori youth justice officer and family friends. Defence lawyer Amanda Hurst told the court her client was a young man who did not appear to have been in custody before.She said he was able to obtain work and drug and alcohol counselling through services at the Ballarat and District Aboriginal Cooperative, if he was bailed. Or, she said he could return to Port Lincoln in South Australia on bail where he had work on the wharves with immediate family.Police prosecutor Leading Senior Constable Steve Kent opposed bail, saying Prestage had a number of previous warrants for failing to appear.Magistrate Peter Couzens adjourned the matter until today.
