Simon Buchmasser is charged with rape, sexually penetrating a girl under 16 and distributing child abuse material.

He faced the Ballarat Magistrates' Court on Tuesday after being arrested and made a self-represented application for bail.

Police prosecutor Senior Constable Ben Jones said Buchmasser allegedly contacted a 15-year-old female one month ago on Snapchat and arranged to meet with her to have sex at a hotel.

The court heard Buchmasser met the complainant at a Warrnambool hotel on January 5, 2020, purchased alcohol and allegedly sexually assaulted her.

Senior Constable Jones said he video recorded the complainant performing oral sex on his phone and filmed himself inserting an empty Cruiser alcohol bottle into her vagina.

It is alleged days later the female's younger sister received text messages from Buchmasser asking for nude photos.

The court heard the sister did not send any photos and it is alleged Buchmasser then sent a video recording in Snapchat showing the complainant performing oral sex.

Senior Constable Jones said on January 10, 2020 the sister and mother made a report to police and the victim made a statement.

The court heard the victim said she attended the hotel with the intention of having sex, told Buchmasser she was 15-years-old, asked him to buy her alcohol and consumed it prior to having sex.

The court heard the complainant told police she consented to the recording but did not think her face would be shown, but she did not consent to him sending it or to the bottle being inserted into her vagina.

Police confirmed Buchamsser had made a booking with the hotel and confirmed the use of the taxi.

Police executed an evidence warrant at Buchmasser's Ballarat home on Tuesday and seized his mobile phone and tablet.

The court heard he made a no comment interview and did not show remorse or care.

Senior Constable Jones said it was alleged the offences were committed while on a community corrections order for prior offences including blackmail and drugs, which he was released from prison for in October.

The court heard Buchmasser had refused to provide the pin number for his phone to police.

"Police allege he is an unacceptable risk, believe he will contact vulnerable children and believe he has access to other children and material on his phone," Senior Constable Jones said.

Buchmasser argued he met compelling reasons to receive bail as he intended to plead not guilty, he had stable accommodation and had not failed to appear on bail in the past.

Magistrate Leonard Brear said his failure to give police access to his phone was of significance to the court.

In response, Buchmasser said he would consider providing his pin number. He said he believed his mental health would deteriorate if remanded in custody.

Mr Brear said he had failed to show compelling reasons and he was considered an unacceptable risk of re-offending and endangering the safety and welfare of any person.

"You failed to present your password to your phone to police," he said.

"There is a concern of risk of like offending against another child."

Buchmasser was refused bail and remanded in custody to appear at the Warrnambool Magistrates' Court on March 27 for a committal mention.
